TERMS OF SERVICE

1. Agreement to Terms

These Terms of Service (“Terms”) are an agreement between you and Phoenix Protocol Pte. Ltd. (“Phoenix,” “we,” “us,” or “our”) and apply to your use of the Phoenix website, web app, mobile apps and related services (together, the “Service”). They also serve as the end-user license agreement for the Phoenix mobile apps.

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Description of Service

Phoenix is a health and wellness platform and community for people with genetic risk factors for cognitive decline, especially APOE4 carriers. Depending on your plan, the Service includes:

• Your personal protocol and monthly review
• AI reading of your blood tests against APOE4-informed ranges, and your trends over time
• Daily check-ins, experiments and health tracking
• Integration with Apple Health and Google Health Connect
• Your pod, matched monthly, and the members-only Phoenix Community
• Research, clinical-trial opportunities and partner discounts
• Educational content and resources

What's included depends on your plan; for example, the Ember plan does not include the app. Research and clinical-trial opportunities depend on each study's own criteria, so we can't guarantee a place in any particular trial.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you are.

4. Account Registration and Security

To use the Service, you create an account. Please give us accurate information and keep it up to date. You are responsible for keeping your login details safe and for activity on your account. If you think someone else has accessed your account, let us know right away.

5. Subscription and Payment

5.1 Subscription Terms

The Service is offered as a paid subscription. Plans, prices and billing periods are shown before you buy. By subscribing, you authorise us to charge your payment method for your plan. Your subscription renews automatically at the end of each monthly or annual billing period until you cancel. If the price of your plan changes, we'll let you know before the new price applies to you.

5.2 Payment Processing

Payments are processed by Stripe, our payment provider. We do not store your full card details on our servers.

5.3 Cancellation and Refunds

You can cancel anytime from the billing section of your account or by emailing kevin@thephoenix.community. There are no cancellation fees, and you keep access until the end of the period you've paid for.

60-day money-back guarantee. If within 60 days of your membership starting you feel Phoenix wasn't worth it, email kevin@thephoenix.community and we'll refund what you paid in full, no questions asked. After those 60 days, payments are non-refundable, except where the law requires otherwise.

6. User Responsibilities and Conduct

You agree to:

• Use the Service only for lawful purposes and in line with these Terms
• Provide accurate and truthful information
• Respect the privacy and confidentiality of other community members
• Not share content from the private community outside the community without consent
• Not engage in harassment, abuse, or harmful behaviour towards other users
• Not attempt to gain unauthorised access to any part of the Service
• Comply with all applicable laws and regulations

7. Community Guidelines

The Phoenix Community is a private, members-only space. All discussions and personal information shared within the community are confidential. Members are expected to maintain this confidentiality and not share other members' information outside the community. You may use a pseudonym within the community if you prefer. Repeated or serious breaches of the community guidelines may lead to suspension of your account.

8. Health and Medical Information

Phoenix provides health information, tools and community support. It does not diagnose, treat, cure or prevent any disease, including Alzheimer's disease, and it is not a substitute for professional medical advice, diagnosis or treatment.

Please talk with your doctor or another qualified health professional about your health, and before making changes to your medications or supplements. Don't ignore professional medical advice or delay seeking it because of something you read on Phoenix. If you think you may have a medical emergency, call your doctor or emergency services right away.

AI-read results. Phoenix uses AI to read the lab reports and documents you upload and to prepare your insights. We work hard to get every value right; if something doesn't match your original report, let us know and we'll correct it. The target ranges shown for APOE4 carriers are guidance to discuss with your doctor.

Calls and sessions with Kevin or other experts are educational and do not create a doctor–patient relationship. Opinions shared by other members in the community are their own.

9. Intellectual Property

The Service and its original content (excluding content provided by users), features and functionality belong to Phoenix Protocol Pte. Ltd. and its licensors and are protected by copyright, trademark and other laws. Please don't copy, modify, distribute, sell or lease any part of the Service without our written permission.

10. User Content

You retain ownership of any content you submit through the Service. By submitting content, you grant Phoenix a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service. You confirm that you have the right to submit the content and that it does not violate anyone else's rights.

11. Third-Party Services and Integrations

The Service may integrate with third-party services such as Apple Health and Google Health Connect. Your use of these services is subject to their own terms and privacy policies, and we are not responsible for them.

12. Disclaimer of Warranties

We work hard to keep the Service available, secure and accurate, but it is provided “as is” and “as available.” To the extent the law allows, we make no other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we can't promise that the Service will always be uninterrupted or error-free.

13. Limitation of Liability

To the extent the law allows, Phoenix Protocol Pte. Ltd. and its directors, employees, partners and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, use or goodwill, arising from your use of the Service. Our total liability for any claim relating to these Terms or the Service is limited to the amount you paid us in the twelve (12) months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify Phoenix Protocol Pte. Ltd. and its officers, directors, employees and agents against claims, losses and reasonable legal costs arising from your breach of these Terms or your misuse of the Service.

15. Termination

You can close your account at any time from your profile in the app or by emailing kevin@thephoenix.community. We may suspend or close an account that breaks these Terms or puts other members at risk. If we close your account for any other reason, we'll refund the unused part of any period you've paid for.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Singapore, and the courts of Singapore have jurisdiction over any dispute relating to them or to the Service. If you live in a country whose consumer laws give you rights that a contract cannot take away, nothing in these Terms affects those rights.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the new version here and update the Effective Date, and we'll let you know about significant changes. If you keep using the Service after a change takes effect, the updated Terms apply.

18. Severability

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms still apply.

19. Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and Phoenix about the Service and replace any earlier agreements about it.

20. Community Research

Phoenix studies member data in aggregate to produce Community Research — group-level findings about what helps APOE4 carriers, always shared in anonymous, community-wide form. Personal results are never published, and findings only come from groups large enough that they describe the community rather than any individual. Full details, including how to opt out, are in our Privacy Policy, Section 13, Community Research.
